How we work
An advertisement is an advertisement
Section 6(1) of the Digitale-Dienste-Gesetz (DDG, the German act on digital services) states: “When making commercial communications that are digital services or components of digital services, service providers must at least observe that 1. commercial communications must be clearly recognisable as such, […]” (our translation; only the German wording is authoritative). At present this website contains no advertising and no partner links: explanations, checklists and tools are provider-neutral. If a partner link is added, it will appear only in a box headed “Advertisement” on the page Start your own newsletter – never in articles on law, deliverability or metrics.
Publisher
newsletter-marketing24.de belongs to fusePRO Online Marketing, owner Dennis Hain, Wiesbaden (full details in the Legal notice). The articles are written by the newsletter-marketing24.de editorial team; we do not use author names with no one behind them.
Three kinds of sources
- Law, case law, supervisory authorities, standards: gesetze-im-internet.de, EUR-Lex, the German Federal Court of Justice, the German Data Protection Conference (Datenschutzkonferenz) and the IETF’s RFCs.
- Information from mailbox providers: what Gmail, Yahoo and Microsoft require from senders. Because these rules change, every such statement carries a status date.
- Reference works such as Wikipedia: only as a starting point for research, never as evidence.
Law only as quotation – not legal advice
On legal questions such as consent, double opt-in, advertising to existing customers, unsubscribing or the labelling of advertising, we exclusively reproduce verbatim quotations: from laws (UWG, GDPR, DDG, TDDDG – mostly German and EU law), from court rulings with case number and paragraph number, and from publications of the German data protection authorities, such as the guidance on direct marketing of the Data Protection Conference (Datenschutzkonferenz). Quotations are in quotation marks, omissions are marked with […], and every source is listed with its retrieval date in our list of sources. In this English version, GDPR quotations follow the official English text; quotations from German laws, rulings and authority papers are our working translations, and only the German wording is authoritative.
We give no legal assessments, evaluations or recommendations with legal effect of our own. Our own text is limited to neutral transitions and to factual information without legal effect, for example on technology, deliverability and metrics. Where the quoted texts do not expressly answer a question, we say so instead of guessing. No lawyer has reviewed these pages. For your specific case these pages are therefore no substitute for advice from a lawyer.
How software helps write this site
We use AI-based tools when writing. For every statement of fact – whether a statutory provision, a court ruling or a mailbox provider’s sender rule – we keep the evidence in our register of sources. Before a page goes online, an independent checking agent picks out individual statements and compares them with the legal text or the provider’s information; it checks legal quotations against the original wording. A complete check of every statement by a human is not part of this process. fusePRO Online Marketing, owner Dennis Hain, remains responsible for the content. You will find the date of the last check on every page.
We do not send anything
A newsletter website without a newsletter, of all things: not a single email goes out from here, and there is no sign-up form. Our tools calculate exclusively in your browser.
For statistics we use a self-hosted Matomo without cookies; more in the privacy policy.
This English version
This English version has been translated from the German original. The translation was done with the help of AI and checked by machine (completeness, figures, names, sources) and by a back-translation of sample pages; it has not yet been proofread by a native speaker. If the two versions differ, the German version applies. Many of our sources are German legal texts; they are listed under their original titles and marked “(in German)”. The requirements of Gmail, Yahoo and Microsoft are cited from their English originals where available.
